Accepting These Terms
This website is operated by Ross Bindery, Inc. (“Ross Bindery,” “we,” “us,” or “our”), a commercial trade bindery in Santa Ana, California. By using this site or submitting a project through it, you agree to these terms. If you do not agree with them, please do not use the site.
If you are using this site for a company, you confirm you are authorized to accept these terms on that company’s behalf.
Our Privacy Policy explains how we handle information and forms part of these terms.
What This Site Is For
This site describes the binding and finishing capabilities Ross Bindery offers to the printing trade, and gives customers a way to submit a project for review.
The descriptions here are general. Whether we can run a particular job depends on the materials, construction, quantity, dimensions, schedule, and the equipment available at the time. Nothing on this site is a guarantee that a specific capability, specification, or turnaround is available for your project.
Project Submissions and Estimates
Submitting the intake form starts a conversation. It is not an order, and it does not create a contract between us.
- Submitting a project does not reserve production capacity or confirm a delivery date.
- Selecting a rush option flags your request for review. It does not confirm that rush turnaround is available.
- The confirmation email you receive acknowledges that your submission arrived. It is not a quotation.
- Any estimate we provide is based on the information available at the time and may change if the specifications, materials, quantity, or schedule change.
Work begins only when we have agreed on the scope in writing. Where we have a separate quotation, purchase order, credit agreement, or terms of sale with you, those documents govern the work itself, and they take precedence over these website terms if the two ever conflict.
Files and Materials You Send Us
When you upload artwork, diagrams, purchase orders, or other files, you confirm that:
- You own the material or have permission to send it to us and to have it produced
- Producing it will not infringe anyone’s copyright, trademark, or other rights
- It contains no malicious code
- You have the right to share any personal information it contains, and you have included only what the project requires
You keep ownership of what you send us. You grant us permission to use, copy, store, and process it only as needed to review, quote, and produce your project, and to share it with the trade partners and carriers involved in completing that work.
We are not a file archive. Please keep your own copies of anything you send. We are not responsible for the loss or corruption of submitted files.
Do not upload government identification numbers, financial account numbers, health information, or similar sensitive data through this website. If a project genuinely requires handling data of that kind, contact us first so it can be arranged appropriately.
Acceptable Use
Please use this site for its intended purpose. You agree not to:
- Submit false, misleading, or automated form entries
- Attempt to gain unauthorized access to the site, its systems, or its underlying infrastructure
- Interfere with the site’s operation or place unreasonable load on it
- Scrape or harvest content or contact information
- Use the site to send unsolicited commercial messages
- Use the site for any unlawful purpose or in violation of these terms
We may restrict or refuse access to anyone who misuses the site.
Our Intellectual Property
The content of this site — text, layout, diagrams, photographs, and the Ross Bindery name and logo — belongs to Ross Bindery, Inc. or is used with permission. You may view and print pages for your own business use in evaluating our services.
Please do not republish, redistribute, or use this content commercially, or use our name or logo, without our written permission.
Third-Party Sites and Services
This site links to and embeds services operated by other companies, including mapping and directions. We do not control them, we do not endorse their content, and we are not responsible for them. Their own terms and privacy policies apply when you use them.
Disclaimer
This site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Ross Bindery disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that this site will be uninterrupted, error-free, or secure, or that its content is complete, current, or accurate. Descriptions of capabilities are general information, not technical specifications for your job.
This section applies to the website. It does not limit any warranty we separately agree to in writing for work we produce.
Limitation of Liability
To the fullest extent permitted by law, Ross Bindery and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, or lost or corrupted data, arising out of your use of this site — even if we have been advised that such damages are possible.
To the fullest extent permitted by law, our total liability arising from your use of this site will not exceed one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Ross Bindery, Inc. and its officers, employees, and agents from any claims, damages, losses, liabilities, and reasonable legal costs arising out of your use of this site, your breach of these terms, or any claim that material you sent us infringes someone’s rights or was submitted without proper authority.
Governing Law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from these terms or from your use of this site will be brought in the state or federal courts located in Orange County, California, and you agree to the jurisdiction of those courts.
If any part of these terms is found unenforceable, the rest remains in effect.
Ross Bindery should confirm the governing law and venue above with its attorney, and decide whether to add an arbitration or dispute-resolution clause.
Changes to These Terms
We may update these terms as our site or business changes. The current version is always posted here, and the effective date at the top tells you when it last changed. Continuing to use the site after a change means you accept the updated terms.
